UAE to Enforce Strict New Telemarketing Regulations

In a significant move to protect consumer privacy, the UAE is set to enforce strict new rules for telemarketing. Starting mid-August 2024, the Ministry of Economy, alongside the Telecommunications and Digital Government Regulatory Authority (TDRA), will implement comprehensive regulations to control telemarketing practices within the country.

The new regulations were announced on June 9 and aim to address the widespread annoyance and privacy concerns associated with unsolicited marketing calls. Failure to comply with these rules will result in hefty fines of up to Dhs150,000, potential suspension of telemarketing activities, cancellation of licenses, and denial of telecommunications services for up to a year.

Key Regulations:

  1. Approval Requirement: Telemarketing companies must obtain prior approval from the relevant authorities before engaging in telemarketing activities.
  2. Registered Numbers: Marketing calls can only be made from phone numbers registered under the licensed company. Telemarketers are prohibited from using personal numbers for business calls.
  3. Calling Hours: Telemarketing calls are restricted to the hours between 9 AM and 6 PM. Calls outside this time frame are strictly prohibited.
  4. Single Attempt Rule: If a consumer rejects a service or product during the first call, telemarketers are not allowed to recall the same consumer on the same day.
  5. Consumer Consent: Before pitching any product or service, telemarketers must ask consumers if they wish to continue the call.
  6. Complaint Mechanism: Consumers can file complaints with the relevant authorities if telemarketers violate these rules.

These regulations also extend to marketing text messages and social media marketing messages, ensuring a comprehensive approach to consumer privacy protection. The rules will be applicable to all licensed companies in the UAE, including those operating within free zones.

The introduction of these stringent measures comes as a relief to many residents who have grown frustrated with persistent and intrusive telemarketing calls. The new framework aims to balance the needs of businesses to reach potential customers with the rights of consumers to enjoy privacy and peace of mind.

By enforcing these regulations, the UAE underscores its commitment to safeguarding consumer rights and enhancing the overall quality of life for its residents. The initiative reflects a broader trend towards stricter data protection and privacy laws in the region, aligning with global standards.

As the implementation date approaches, telemarketing companies will need to adapt to these new requirements swiftly to avoid penalties and ensure compliance. Consumers, on the other hand, can look forward to fewer interruptions and more control over their personal communication channels.

This proactive approach by the UAE authorities marks a significant step towards creating a more respectful and regulated telemarketing environment, ultimately benefiting both businesses and consumers.
