The arrest happens less than a month after the Chinese Cyberspace Administration published preliminary guidelines for ChatGPT-style sites, which warn that generative AI must not create content that undermines the government.

In a statement issued on Sunday, police in the northwest province of Gansu claimed that the putative suspect, who could only be named by his last name, Hóng, was charged with utilising an AI-driven text generator to produce what the authorities have dubbed "false information" about a train crash that allegedly killed nine people.

This is the first criminal case related to ChatGPT in China and around the world.

“Hong used modern technology to fabricate false information, spreading it on the internet, which was widely disseminated,” the Gansu police said in the statement, adding that the investigation was still ongoing.

The story was reported by 25 Baijiahao accounts, a blog-style platform owned by China’s tech giant Baidu, with IP addresses from different locations.
